1) Jade would be using the spiritual magic, and he would be able to notice that his magic has a different source. His spear would still be taken away.

2) When regaining their sylladex, they would be allowed to regain one actually usable item along with it, since an empty sylladex is pretty useless. Further items would need to be regained one at a time.
